Conditions of purchase of products and services from Sellers present on www.destinazionebasilicata.com

1. Purchase of products and services

Buy or book your products, vouchers and services through www.destinazionebasilicata.com (hereinafter the "Platform"). The Terms of Use, these Terms of Purchase and your order apply to your purchases and reservations. You can also make donations to subjects who can receive them.

The products and services are sold to you directly by the seller who sells on the Platform (Seller). Destination Basilicata S.r.l. (hereinafter DB) has no responsibility for purchases and reservations, except for the DestCard, the nominative digital card, for which DB is the only Seller and the only sales channel of the card is the Platform. Check the seller's details in their platform showcase.

The purchase is a distance contract governed by articles 50 ff. Of the Legislative Decree 6 September 2005, n. 206 (Consumer Code), and by Legislative Decree 9 April 2003, n. 70 (c.d. Law on Electronic Commerce).

The sale of products is intended for consumers.

Your personal data is processed according to the Privacy Policy (basis of processing: the purchase contract). If you register you will find your orders and any information saved in the infobag on your devices (smartphones, tablets, computers, etc.). If you do not register, you will not be able to check your orders on the Platform but you must keep the order summary email.

Some products or services may be subject to limitations (e.g. minimum order). Deliveries will take place in the delivery areas provided by the Seller. If your order does not comply with the limitations, it will be refused and any payments made will be refunded by the Seller. If you buy alcoholic beverages you must be of legal age.

Food products such as vegetables, meat, cheeses, not industrially packaged, are sold by the piece. The price refers to single lots. The indicative weight and, where foreseen, the place of origin, rearing and/or slaughtering are provided.

The products may contain allergens (nuts, soy, milk, gluten, etc.). In case of allergies, contact the Seller directly or check the ingredients. The Sellers are responsible for their own data and information, including photos, availability, prices, delivery, applicable conditions, etc. Photos and drawings are intended to present the product or service and may not be representative of details and accessories, only the description present is authentic. The Seller enters his data and information in his own language which is the authentic version with reference to the products and services offered. The translation into other languages may not be perfect, if you find any anomaly check the Seller's language and, if you want, report it to segreteria@destinazionebasilicata.com.

To travel to Italy, you must have a valid identity document (identity card, passport or similar).

The Platform does not apply any charges on the purchase. Only professionals who have a contractual relationship with DB are present on the Platform.

 

2. Order confirmation, use of services and communications

You will receive an order summary e-mail which will contain the Seller's confirmation, the order number, the details and the link to these Conditions of Purchase. In case of unavailability of the product or service, you will be contacted by the Seller promptly to agree on different methods of execution of the service, delivery of the product, replacement or cancellation of the order, in the latter case you will be refunded on the same payment method used.

The virtual experiences will be usable online according to the timing and methods of use specified in the description. In the event of non-use as provided, the experience will no longer be usable and the amount paid will not be refunded.

As a voucher for professional services or open date services, you will receive a code to be presented when booking.

As a voucher for fixed date events or tours, you will receive a code to be presented at the event.

Vouchers are replaced by tickets by the Seller.

If you arrive late for an experience or tour you must contact the Seller who may not return the price paid. Check the description for any charges applied. DB has no responsibility in case of delays.

 

3. Home delivery and in-store collection

The Seller will deliver the products to you at the address provided and take care of the transport requirements, e.g. the cold chain.

Shipments are made within 7 days of the Seller's confirmation, unless otherwise communicated. DB is not responsible for further communications with the Seller, even if they transit through the Platform. We cannot guarantee that all communications will be successful, or that they will be read or accepted by the Seller.

The delivery conditions (times, areas, etc.) are present in the descriptions, if they are not specified they will be communicated by the Seller, timely delivery is not ensured in these cases. Delivery will be made to the floor, except for heavy packages.

Some orders can be canceled after the order summary email if they do not comply with the requirements or if delivery is difficult e.g. unreachable addresses or bad weather conditions. In such cases, if a subsequent delivery cannot be made, the product will be refunded (excluding delivery costs, if incurred) using the same method of payment. Catering services, ready meals and customized products are non-refundable.

If available, you can book collection from the Seller. In this case agree with the activity on the day and time.

 

4. Payments

You can pay online with the secure payment instrument (getway), if supported by your bank.

Payment is made to the Seller, and to DB only in case of purchase of the DestCard.

Payment is upfront and final. In some cases the refund may be limited (check the conditions of withdrawal).

The receipt will be sent with the products or provided upon use of the service.

If you want to make donations, remember that these constitute a non-refundable donation to an authorized organization. You will help the organization to support itself or to reach a specific goal (e.g. you can donate 50 euros to the non-profit organization XYZ which can use it to support itself or to organize an event). DB is not an intermediary but only provides a technical service to the institution. If you want a receipt, contact the institution providing the order number.

DB transmits credit card data via a third-party Payment Card Industry Data Security Standard (PCI-DSS) certified secure getway (Stripe Payments Europe, Ltd.). Except for the limits of the law, DB has no responsibility for the successful completion of the transmission. User data is managed by a PCI DSS compliant computer system. All operations are performed through secure connections using SSL (Security Socket Layer) and https (http secure) protection codes. Except for legal requirements, the data collected will be deleted at the end of the treatment. In any case, DB is not responsible for fraud or abusive use of credit card details by third parties, without prejudice to legal obligations. The getway provides all or part of its services from local systems in the United States or in other countries outside Italy, therefore the data may be transmitted, processed or stored outside the national territory, and could be communicated in line with applicable law, please please refer to our Privacy Policy.

Most banks or credit card issuers bear the risk of fraud or unauthorized use of the credit card, you should refer to your company to verify any coverage. Errors or insufficient invalid data may cause the booking to be canceled or refund denied.

DB does not ask for your credit card or bank details other than those you provide at the time of purchase on the Platform. If you receive these requests in our name or for transactions made through the Platform, do not provide your data.

When you contact the Seller directly, if you have paid for products and services through the Platform, you will not be asked for any data, except for the order number. If you purchase or book a product or service using the contacts on the Platform but not through the Platform, use the normal care necessary for remote purchases.

 

5. Withdrawal from the purchase of open date products or services (including vouchers)

Before the Seller's order confirmation referred to in the summary email, you can withdraw from the purchase by sending an email to the Seller to the contacts on the Platform; the purchase amount will be credited back to the same payment instrument used.

After confirmation it is no longer possible to proceed with the withdrawal, except in the terms described below.

You can withdraw from the order for products, services, vouchers and open date tours, within 14 days. from receipt of the last product/voucher purchased by sending an e-mail to the Seller and, possibly, a registered letter with acknowledgment of receipt within the following 48 hours.

You will have to return the product to the Seller at your expense with a courier of your choice within 14 days. from the moment you exercised the withdrawal.

The amounts paid (excluding shipping costs) will be refunded to the same payment method used for the purchase as soon as the product is received, or proof of shipment will be provided within 30 days. from the withdrawal.

In accordance with the art. 59 of the Consumer Code, withdrawal is not possible for purchases of: 1. perishable goods (e.g. fresh produce); 2. fixed date catering; 3. ready meals, customized or personalized goods or preparations (e.g. tailoring, gastronomy, etc.); 4. goods sealed but opened after delivery or mixed inseparably with other goods; 5. underwear; 6. newspapers and periodicals; 7. products to be registered with the manufacturer before use (e.g. MP3 players, navigators, etc.); 8. virtual products, gift cards, virtual top-ups, etc.); 9. open audiovisual products (e.g. DVDs, video games, CDs, etc.); 10. prepaid cards already activated.

In these cases, if you receive a non-compliant product (e.g. a product of a different type or obviously faulty) send the report by e-mail to the Seller, accompanied by photos, if possible, within 24 hours of delivery. If possible, the Seller will replace the product with the compliant product.

NB: if you have purchased products referred to in numbers from 1 to 3 and have chosen to collect them from the Seller, if you do not collect them within the set times, you will not be refunded any amount.

 

6. Withdrawal from fixed-date stays, experiences, services and tours (including vouchers)

Send an e-mail to the Seller's contact details, and possibly a registered letter with return receipt within the following 48 hours. The Seller may withhold an amount, depending on when you exercise the withdrawal. The amounts withheld are calculated on the "Value" or on the Price paid, including taxes, surcharges, deposits or other.

Unless otherwise specified in the description, the Value will be refunded as follows:

100% if the withdrawal is exercised within 30 days before the fixed date;
75% if the withdrawal is exercised between the 29th and 21st day before the fixed date;
60% if the withdrawal is exercised between the 20th and 15th day before the fixed date;
50% if the withdrawal is exercised between the 14th and 18th day before the fixed date;
40% if the withdrawal is exercised between the 7th and 4th day before the fixed date;
25% if the withdrawal is exercised between the 3rd and the day before the fixed date;
0% if the withdrawal is exercised on the day of the fixed date or in case of no show.

DB is not responsible for amounts applied to the Seller, even if unauthorized or incorrect, you cannot make claims for fees that have been applied correctly.

 

7. Claims for Services

Claims or refund requests must be sent to the Seller within 30 days of service; otherwise they will not be accepted.

Consumers from the European Union can contact the Seller for assistance through the available channels. You can also use the online dispute resolution tool made available by the EU: Online DR.

 

8. Modifications to the Conditions of Purchase

These Conditions of Purchase may be modified at any time, without providing prior notice by publishing the new version on this site, the new Conditions of Purchase will apply from the purchase following publication, please print or save a copy of these Conditions of Purchase and order receipt email.

 

9. Survival

If any provision of these Conditions of Purchase is held to be unenforceable or invalid, the same will be changed and interpreted to achieve its objectives to the maximum extent possible under applicable law and the remaining provisions will continue in all respects and effects.

 

10. Law and Jurisdiction

These Conditions of Purchase are governed by Italian law. Consumer users with habitual residence in the European Union can benefit from the protections applicable in their country of residence. As a consumer, you may bring the dispute before the Court of the Member State of the European Union in which you have your residence or habitual domicile in relation to these Conditions of Purchase.
